THE BOARD OF STEPHENS COUNTY COMMISSIONERS met in regular session July 21, 2025, with Todd Churchman, Chairman, present; Kreg Murphree, Vice-Chairman, present; Russell Morgan, Member, present; and Jenny Moore, County Clerk, present.

Others present: List in County Clerk’s Office.

Agenda filed 7-17-25 @ 2:35 P.M. at the front entrance of the Courthouse and the Commissioners’ meeting room. 

Chairman Churchman called the meeting to order.

Motion by Murphree, seconded by Morgan to approve minutes of the previous meeting.  Voting: Churchman, aye; Murphree, aye; Morgan, aye.

Motion by Churchman, seconded by Morgan to approve the payment of purchase orders, including an overage on blanket purchase order #5558 in the amount of $3,148.03 from the Highway Fund, and issuance of blanket purchase orders.  Voting: Churchman, aye; Murphree, aye; Morgan, aye.

Motion by Morgan, seconded by Murphree to approve an Application for Permit – Commercial Right of Way Activity & Roadway Borings from WW Builders, Inc., to erect, construct, and maintain a waterline along, upon, or across said county highway or road(s) for the purpo9se of transporting, selling, and using water in Section 25, Township 2 North, Range 9 West in District #1.  Voting: Churchman, aye; Murphree, aye; Morgan, aye.

The Board heard from Construction Manager, Butch Lawson, regarding the ARPA grant and/or ARPA projects for Stephens County.  Lawson gave a report regarding the Fairgrounds Upgrade first.  The concrete vendor is still working.  The arena is being cleaned out so that the lights can be hung before the Fair.  Lawson will check to see if a fiber line is scheduled for boring.  Electricians are working inside the new conference center area. Regarding the courtroom, Lawson reported that the painters are actively working. Dropped ceiling tiles have been installed.  Lawson said that some materials may not be delivered before the beginning of the August jury docket.  If materials are delayed, work will pause during the August jury term and then begin again until the beginning of the October jury term.

Motion by Morgan, seconded by Murphree to enter into Executive Session related to the following: Sarah Hicks, as Special Administrator of the Estate of Mickey Anderson, Deceased v. Rick Lang, in his official capacity as Stephens County Sheriff, Board of County Commissioners for Stephens County, Oklahoma; Joshua Hawkins and Turn Key Health Clinics, LLC, an Oklahoma limited liability corporation, Case No. CIV-25-281-D, United States District Court for the Western District of Oklahoma, upon the advice of legal counsel, for the purpose of confidential communications between the Board and its attorney concerning the lawsuit previously referenced.  Public disclosure of these confidential communications would seriously impair the ability of the Board and its attorney to properly process and defend this litigation.  As such, the communications in the Executive Session are confidential.  AUTHORITY: Title 25 Okla. Statute, § 307 (B)(4).  Voting: Churchman, aye; Murphree, aye; Morgan, aye.

Motion by Morgan, seconded by Churchman, to return to Regular Session.  Voting: Churchman, aye; Murphree, aye; Morgan, aye.

No action was taken by the Board related to the Executive Session identified immediately above.

Motion by Churchman, seconded by Murphree to enter into Executive Session related to the following: Duncan Regional Hospital, Inc., in the Matter of the Application and Petition to Vacate and Foreclose the Right to Reopen the Public Way and Portion of the Platted Duncan Regional Loop Road between Jackie Road and Whisenant Drive, in the City of Duncan, Stephens County, Oklahoma, v. Board of County Commissioners of Stephens County, Case No. CV-2025-140, District Court Stephens County, upon the advice of legal counsel, for the purpose of confidential communications between the Board and its attorney concerning the lawsuit previously referenced.  Public disclosure of these confidential communications would seriously impair the ability of the Board and its attorney to properly process and defend this litigation.  As such, the communications in the Executive Session are confidential.  AUTHORITY: Title 25 Okla. Motion by Morgan, seconded by Churchman to approve an Engagement Letter between Stephens County (the County) and the Office of the Oklahoma State Auditor and Inspector for the audits of the Fiscal Years 2023 and 2024 and will include an audit of the Coronavirus State and local Fiscal Recovery Funds (CSLFRF).  Voting: Churchman, aye; Murphree, aye; Morgan, aye.

Motion by Murphree, seconded by Churchman to approve a Transfer of Appropriations within the Free Fair Building Fund and the Rural Fire-ST Fund.  Voting: Churchman, aye; Murphree, aye; Morgan, aye.  1215-4-4700-2005, M&O, $2,500.00 to 1215-4-4700-2015, Premiums & Awards, $2,500.00; 1321-2-8210-2005, M&O, $160,000.00 to 1321-2-8210-4110, Capital Outlay, $160,000.00; 1321-2-8220-4110, Capital Outlay, $5,000.00 to 1321-2-8220-2005, M&O, $5,000.00.

Motion by Morgan, seconded by Murphree to approve a Fiscal Recovery Expenditure Documentation Form granting approval for the ARPA Courthouse Annex Upgrade Project in the amount of $241,170.58.

The Board acknowledged the Appointment of Brandon Simpson and Laveda Simpson as Receiving Officers for the Velma Fire Department.

Motion by Murphree, seconded by Churchman to approve Agreement #2025-210 between the City of Comanche and the Board of County Commissioners of Stephens County for the detention of persons in the Stephens County Jail who have been arrested for violations of municipal or state criminal law by the Comanche Police Department for Fiscal Year 2025-2026, to be renewed each fiscal year unless terminated by either party upon the presentation of a sixty (60) day written notice.  Voting: Churchman, aye; Murphree, aye; Morgan, aye.

Motion by Churchman, seconded by Murphree to approve Contract/Agreement #2025-211 by and between the Board of County Commissioners of Stephens County on behalf of the Stephens County Sheriff’s Office (SCSO) and the Comanche Public Schools (CPS) for the purpose of furnishing by SCSO of law enforcement and School Resource Officer functions (Services) to CPS for a term beginning August 1, 2025 to May 31, 2026.  Voting: Churchman, aye; Murphree, aye; Morgan, aye.

Motion by Morgan, seconded by Murphree to approve Stephens County Fair & Expo Center Rental Agreement #2025-212 by and between the Stephens County Fair & Expo Center “Fairgrounds” by and through the Stephens County Board of County Commissioners and Ana Garcia for a Gender Reveal event to be held in the Winchester Room on July 26, 2026.  Voting: Churchman, aye; Murphree, aye; Morgan, aye.

Commissioner Morgan wanted to report to the Board updates regarding the Stephens County Fair & Expo Center.  Morgan said that there was a horsemanship event held last Tuesday through Saturday.  The Fairgrounds’ staff was trying to get the event cleaned up so that the electricians and the fire suppression vendor could complete their tasks in preparation for the Fair.
